Supporting Heroes Disability Services

These Terms & Conditions govern the use of services provided by Supporting Heroes Disability Services (“Supporting Heroes”, “we”, “us”, or “our”).
By engaging our services, submitting an enquiry, or accessing our website, you agree to be bound by these Terms & Conditions.
If you do not agree with these Terms & Conditions, you should not proceed with services or submit forms through our website.
1. About Supporting Heroes Disability Services
Supporting Heroes Disability Services is an Australian disability support provider founded and operated by Sam Smyth, delivering personalised, relationship based support to individuals with disability and their families, primarily across southern Adelaide and surrounding areas.
Our services may include (but are not limited to):
In home support
Community access and participation
Behavioural support (non clinical)
School holiday and day programs
Short term accommodation
Specialised programs (including boys only programs aged 15–25)
2. Eligibility for Services
Services are provided to:
Individuals with a disability (including NDIS participants and non NDIS clients)
Families, carers, and guardians acting on behalf of participants
All services are subject to:
Capacity and availability
Suitability and safety assessments
Alignment with our scope of practice
We reserve the right to decline or discontinue services where needs fall outside our expertise, resources, or safety parameters.
3. Service Agreements & Individualised Support
Where ongoing support is provided, a Service Agreement may be established outlining:
Type and frequency of support
Duration of services
Fees and funding arrangements
Cancellation and notice requirements
Support plans are developed collaboratively with participants and/or their guardians and may be reviewed or adjusted as circumstances change.
4. NDIS & Funding Responsibilities
Where services are funded through the NDIS:
It is the responsibility of the participant or nominee to ensure sufficient funds are available.
We do not guarantee NDIS approval or plan outcomes.
Services delivered will be billed in accordance with the current NDIS Pricing Arrangements and Price Limits, where applicable.
For privately funded services, fees must be paid as agreed prior to or at the time of service delivery.
5. Cancellations & Changes
Unless otherwise stated in a Service Agreement:
We request reasonable notice for cancellations or schedule changes.
Late cancellations or no shows may be charged in line with NDIS or private fee guidelines.
Changes to recurring supports may require written notice.
We aim to be flexible while maintaining fairness and sustainability for all parties.
6. Behaviour, Safety & Duty of Care
Supporting Heroes is committed to providing a safe, respectful, and supportive environment.
Participants, families, and carers agree to:
Treat staff with respect and dignity.
Disclose relevant risks, behaviours of concern, medical needs, or safety issues.
Work collaboratively to support safe service delivery.
We reserve the right to pause or withdraw services if:
There is an unacceptable risk to staff, participants, or the public.
Critical information has been withheld.
Behaviour places others in immediate danger.
7. Nature of Support & Limitations
Supporting Heroes provides non clinical disability support services.
We do not provide:
Medical advice or treatment.
Psychological or psychiatric therapy.
Crisis or emergency intervention services.
Participants should seek appropriate medical, clinical, or emergency services where required.
8. Privacy & Confidentiality
We are committed to protecting your privacy.
Personal information is collected only for service delivery, administration, and legal compliance.
Information is handled in accordance with the Privacy Act 1988 (Cth).
Information will not be shared without consent, except where required by law or to prevent serious harm.
By submitting an enquiry or engaging services, you consent to the collection and use of your information for these purposes.
9. Website & Online Enquiries
By using our website and submitting forms, you acknowledge that:
Information provided is accurate and truthful.
Submission of an enquiry does not guarantee service availability.
We may contact you using the details provided.
Spam, misuse, or fraudulent submissions are strictly prohibited.
10. Intellectual Property
All website content, branding, text, and materials are the intellectual property of Supporting Heroes Disability Services unless otherwise stated.
You may not reproduce, copy, or distribute content without written permission.
11. Limitation of Liability
To the maximum extent permitted by law:
Supporting Heroes is not liable for indirect, incidental, or consequential loss.
We are not responsible for outcomes beyond our reasonable control.
Services are provided with care, skill, and professionalism, but no specific outcomes are guaranteed.
Nothing in these Terms excludes rights under Australian Consumer Law.
12. Changes to Terms & Conditions
We may update these Terms & Conditions from time to time.
The most current version will always be available on our website.
Continued use of services after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms & Conditions are governed by the laws of South Australia and the Commonwealth of Australia.
